Thank you for supporting original artwork and independent creativity. We value the relationships we build with our collectors and customers and strive to provide a thoughtful, professional experience.

These Terms of Service explain the conditions that apply when purchasing original artwork, commissioning custom artwork, purchasing digital products, participating in art programs, or using our website at https://rachelhollandart.com.

By completing a purchase or enrolling in a paid service, you agree to the applicable terms outlined below.

1. Original Artwork Purchases

All original artwork is individually created by artist Rachel Holland and sold as described on our website or through direct communications.

• All prices are listed in U.S. dollars unless otherwise specified.
• Applicable taxes and shipping charges will be disclosed before payment.
• Artwork colors may vary slightly due to differences in screen displays and lighting.
• Each original artwork is unique and may contain natural variations in texture, materials, and finish.
• Purchases are subject to availability and successful payment processing.

Returns and Refunds

We want collectors to feel confident and satisfied with their artwork purchases.

Requests to return completed original artwork will be considered individually. Customers should contact Rachel Holland Art, LLC at rachel@rachelhollandart.com to discuss their concerns before returning any artwork. A 7 day window after arrival of artwork is set as a time of decision-making on whether the artwork may be returned or not.

Approval of a return or refund is not guaranteed. Any approved return will be subject to the conditions communicated in writing, including applicable shipping arrangements.

Customers should not ship artwork back without prior authorization.

Nothing in this policy limits rights or remedies provided by applicable consumer protection laws.

2. Custom Artwork Commissions

Commissioned artwork is created specifically for each customer through a personalized creative process.

Commission Process

• An initial consultation establishes the artwork's subject, size, general color preferences, and other important details.
• A 50% deposit is generally required to reserve a commission and begin the creative process.
• The remaining balance is due before the completed artwork is shipped or delivered.
• Estimated completion timelines will be discussed before work begins.
• The artist retains creative discretion regarding composition, artistic style, materials, and final interpretation.

Changes and Revisions

Reasonable adjustments may be discussed during the agreed-upon development stages.

Substantial changes to the original commission agreement may require additional fees or adjustments to the completion timeline.

As original commissioned artwork reflects the artist's creative interpretation, an exact photographic reproduction is not guaranteed.

Commission Cancellations and Deposits

Commission deposits are refundable if the customer cancels before work on the commissioned artwork has begun, unless otherwise agreed in writing and permitted by law.

Once work on the commission begins, the deposit becomes nonrefundable, subject to applicable law.

Work may include research, preliminary sketches, composition planning, preparation of materials, or painting.

If a customer requests cancellation after work begins, any additional payment obligations will be determined by the individual commission agreement and applicable law.

If Rachel Holland Art, LLC must cancel a commission, any refund will be determined based on the circumstances, work completed, the commission agreement, and applicable law.

3. Payment Processing

Purchases are processed through Stripe-hosted checkout pages connected to our MailerLite website and product services.

Payment methods accepted are those displayed during checkout.

Customers agree to provide accurate billing and contact information.

Orders and services are subject to successful payment processing.

Rachel Holland Art, LLC reserves the right to decline or cancel transactions when reasonably necessary due to suspected fraud, pricing errors, product unavailability, or other legitimate business concerns.

If we cancel an order, payments collected for undelivered products or services will be refunded as required by applicable law.

4. Shipping and Delivery

Original artwork is carefully packaged to help protect it during shipping.

• Shipping costs and arrangements will be communicated during checkout or before final payment.
• Estimated delivery dates are not guaranteed.
• Customers are responsible for providing accurate shipping information.
• Customers should contact us promptly, within 7 days, if artwork arrives damaged or a delivery problem occurs.

Customers are encouraged to retain original packaging and photograph any shipping damage to assist with resolving claims.

5. Digital Products and Art Instruction

Rachel Holland Art may offer downloadable materials, instructional videos, creative resources, and other digital products.

Unless otherwise stated, digital products are licensed for the purchaser's personal, noncommercial use.

Purchasing a digital product does not transfer copyright or grant permission to reproduce, distribute, resell, or commercially exploit the materials.

Digital products may not be shared, redistributed, or uploaded to public platforms without written permission.

Access instructions, delivery details, and any applicable refund conditions will be disclosed at purchase.

6. Dog Mom Art Club Membership

Dog Mom Art Club is a creative membership program designed to help dog lovers express their connection with their pets through art, journaling, and community.

Membership benefits, pricing, billing frequency, and access details will be described on the membership sales or checkout page.

Recurring Payments

For recurring memberships:

• The membership price and billing frequency will be disclosed before enrollment.
• By enrolling, members authorize recurring charges according to the billing terms accepted at checkout.
• Memberships continue renewing for one full year or until canceled according to the applicable cancellation terms.

Membership Cancellation

Members may cancel their membership to prevent future recurring charges.

When a member cancels, access to Dog Mom Art Club content and membership benefits will continue through the end of the current paid billing period.

Cancellation does not automatically entitle a member to a refund for payments already processed.

Any refund requests will be reviewed according to the membership terms disclosed at purchase and applicable law.

Membership Content and Community

Instructional materials, videos, downloadable resources, and other membership content are provided for personal use.

Members may not reproduce, distribute, resell, or publicly share paid instructional content without written permission.

Members participating in community discussions are expected to communicate respectfully and avoid harassment, abusive behavior, or unauthorized promotion.

Rachel Holland Art, LLC may restrict participation for serious or repeated violations, subject to applicable law and any contractual obligations.

We may make reasonable adjustments to program content, schedules, or delivery methods while maintaining the essential benefits described at enrollment.

7. Copyright and Intellectual Property

All original artwork, designs, instructional materials, videos, written content, and other creative works produced by Rachel Holland are protected by applicable copyright laws.

Purchasing original artwork or commissioning a custom painting transfers ownership of the physical artwork upon completion of the sale but does not transfer copyright unless explicitly agreed upon in writing.

Artwork may not be reproduced, commercially distributed, used on merchandise, or otherwise commercially exploited without written permission.

Customers retain their rights to photographs and other materials they submit and grant Rachel Holland Art permission to use those materials as reasonably necessary to fulfill the requested commission or service.

8. Customer Photographs, Testimonials, and Stories

We value the personal stories and relationships that inspire our artwork.

Customers may voluntarily submit photographs, testimonials, pet stories, or other information in connection with commissions and community projects.

We may request permission to share these materials in our portfolio, website, newsletters, or social media.

Identifiable customer photographs and private personal stories will not be publicly shared for promotional purposes without appropriate permission.

9. Website Use

Visitors agree not to misuse our website, interfere with its operation, attempt unauthorized access, or reproduce protected content without permission.

We reserve the right to restrict access when reasonably necessary to protect our website, intellectual property, customers, or business operations.

10. Limitation of Liability

To the extent permitted by applicable law, Rachel Holland Art, LLC is not responsible for indirect, incidental, or consequential losses arising from the use of our website, products, or services.

Nothing in these Terms excludes or limits rights, remedies, or liabilities that cannot legally be excluded or limited.
